JUST BECAUSE THEY ARE SORRY DOES NOT MEAN THEY CARE ABOUT YOU…. "LET’S NOT INVOLVE INSURANCE…..I’LL TAKE CARE OF THE DAMAGE PERSONALLY.”
I have notice that the more clients or potential clients I interview, the less information they have in regards to the accident and other party involved. Here are a couple of things to make sure to get when you are involved in an automobile accident.
RULE # 1: Call the police. If there are no serious injuries, they usually will not come to the scene of the accident.
RULE # 2: Make sure to get ALL the information from the other party involved.
– Take down their name and Drivers License number, if you can, take a picture of it.
– Get their insurance information, make sure it is a valid one – The insurance company name, policy number, and the name of the insured is important.
– Get the license plate number of the car.
– Get the Phone number of the other party.
– If there are any witnesses, make sure to get their names and numbers as well.
RULE # 3: CALL AN ATTORNEY!!!!
MAKE SURE TO CALL ACCIDENT LAWYER OF CALIFORNIA IMMEDIATELY, WHERE YOU WILL BE CONNECTED TO AN EXPERIENCED PERSONAL INJURY ATTORNEY TO EVALUATE YOUR CASE AND HELP GUIDE YOU.
– TAKE PICTURES!
Take pictures of all the vehicles involved and the damage to the vehicles. If possible, the position of the vehicles before they are moved, if it can be done so safely.
Now a days, everyone has a smart phone or picture capability on their phones, therefore, there should not be any excuses as to not getting this relevant and important information.
I understand that some people may be startled, confused, and scared, however, it is very important to stay calm and to ask for this relevant information. YOU ARE ENTITLED TO THE OTHER PARTIES INFORMATION SO THAT YOU MAY REPORT THE CLAIM. Do not be confrontational, and if you start to fear that the other party is getting aggressive, call the police.
Many people will say to you: “lets not go through insurance, here is my number, go get an estimate, and send me the bill, and I will take care of it.” That happens often, and many times, you try and call the other party and they ignore your call.
Therefore, no matter how you decide to resolve the matter, either directly through the other party, their insurance, or your own, make sure to get their insurance information, this will make sure they act with a higher degree of good faith.
